Title: Revision of State Delegate Allocation

This bylaw proposal strikes Bylaw 1 in its entirety and replaces it with the following:

Bylaw 1 – Allocation of State Republican Party Convention Delegates
A. Guiding Principles – The Utah State Republican Party Central Committee allocates the number of State Delegate positions to each County. The Utah County Republican Party shall distribute its allocation in a manner which recognizes the following:
  1. Precinct Representation.
  2. Contribution of Elected Officials and Party Officials.
  3. Relative Republican Strength.
B. Definitions – As used in this bylaw, the following terms shall have the meanings given in this section:
  1. “Caucus State Delegates” shall mean delegates who are duly elected at their precinct caucus to represent the precinct where they reside at the State Convention.
  2. “Ex Officio State Delegates” shall mean delegates who serve ex officio (by virtue of their office) to represent their precinct at the State Convention, pursuant to the conditions set forth in this bylaw. Ex Officio State Delegates shall have the same privileges as Caucus State Delegates.
  3. “Relative Republican Strength” shall mean a rating calculated by aggregating the total combined precinct Republican votes cast at the previous election for governor/lieutenant governor, attorney general, state auditor, and state treasurer, excluding the vote for any candidate who had no opposition.
  4. “State Convention” shall mean the State Nominating Convention or the State Organizing Convention.
C. Allocation of State Delegates –
  1. One Ex Officio State Delegate position shall be allocated to each Precinct Chair.
  2. Additional Ex Officio State Delegates:
    a. One Ex Officio State Delegate position shall be allocated to the following individuals:
      i. Executive Committee Members
      ii. Legislative District Chairs
      iii. Legislative District Vice-Chairs
      iv. Legislative District Education Officers
      v. Federal Republican Elected Officials residing in Utah County
      vi. State Republican Elected Officials residing in Utah County
      vii. County Republican Elected Officials
      viii. State Party Officers residing in Utah County
      ix. The most recently released County Party Chair
    b. The Steering Committee shall identify and invite each person in Bylaw 1.C.2.a. to serve as an Ex Officio State Delegate within one week of receiving the allocation from the state party.
    c. The individuals listed in C.2.a. shall accept the invitation to serve as an Ex Officio State Delegate by notifying the County Chair by the date established by the Steering Committee.
    d. Any Ex Officio State Delegate position invitation that is not accepted shall become a Caucus Delegate position to be allocated according to the provisions in C.3.
  3. Caucus Delegates – The remaining number of state delegate positions shall be allocated proportionately among the precinct caucuses according to their relative Republican strength.
  4. Each Precinct Chair shall be notified of their precinct’s allocation of delegates to the State Convention at least one week prior to the precinct caucus meetings.
  5. The County Party Secretary shall make available, at least one week prior to the precinct caucus meetings, a listing of state delegate allocations which shall include:
    a. The total number of State Delegate positions allocated to Utah County.
    b. The total number of legislative districts in Utah County.
    c. The total number of precincts in Utah County.
    d. The total number of allocated Ex Officio State Delegates.
    e. The total number of allocated Caucus State Delegates.
    f. Individuals who accepted the invitation to serve as Ex Officio State Delegates per section C.2. of this bylaw and their respective office that qualified them for the delegate allocation.
    g. For each precinct, the total number of combined precinct Republican votes cast at the previous election for governor/lieutenant governor, attorney general, state auditor, and state treasurer, excluding the vote for any candidate who had no opposition.
    h. The number of Ex Officio State Delegates and Caucus State Delegates assigned to each precinct.
    i. The ranking of each legislative district according to relative Republican strength.
    j. The ranking of each precinct according to relative Republican strength.
D. Election of State Delegates at Precinct Caucus Meetings –
  1. If a Precinct Chair declines the Ex Officio State Delegate position at the precinct caucus, that position becomes a Caucus State Delegate position to be filled by election at the caucus.
  2. Precinct caucus attendees may elect up to three alternate delegates to fill any delegate vacancies that may occur within that precinct until the next precinct caucus.
E. Election of State Delegates at the County Convention – A list of Ex Officio State Delegates and replacement Caucus State Delegates (pursuant to G.2. below) shall be compiled by the Party Secretary for presentation to the Utah County Republican Party Convention for ratification as State Convention Delegates.
F. Replacement of Ex Officio State Delegates – Ex Officio State Delegate positions are based on party or elected positions held. When the qualifying position is no longer held, the individual will be considered to have resigned as a delegate and his/her replacement, if any, may be invited to become the delegate; unless:
  1. The vacancy occurs after two weeks prior to the State Convention, in which case the replacement will assume the Ex Officio Delegate position immediately following the State Convention; and/or
  2. In the case a Precinct Chair declines the Ex Officio State Delegate position at the precinct caucus, and the resulting Caucus Delegate position is filled by election or appointment, if the Precinct Chair moves from his/her area of eligibility, dies, resigns, or otherwise becomes ineligible to serve, the replacement Precinct Chair does not assume the Ex Officio Delegate position until after the next immediate State Convention; or
  3. In the case an individual listed in C.2.a. declines the invitation to serve as an Ex Officio State Delegate per Section C.2., and subsequently that individual moves from his/her area of eligibility, dies, resigns, or otherwise becomes ineligible to serve, the replacement does not assume the Ex Officio State Delegate position until after the next immediate State Convention.
G. Replacement of Caucus State Delegates –
  1. All replacement Caucus State Delegates shall reside in the same congressional, Utah House, and Utah Senate districts in which the vacancy occurred.
  2. If any precinct caucus fails to elect a Caucus State Delegate allocated to that precinct, the following rules shall apply for filling the vacancy:
    a. The Precinct Chair shall nominate a qualified replacement from the precinct for election at the County Convention, notifying the County Party Chair and County Party Secretary of the nomination within three days of the caucus.
    b. If the Precinct Chair fails to nominate a qualified replacement within three days of the caucus, the precinct’s Legislative District Chair shall nominate a qualified replacement from the legislative district for election at the County Convention, notifying the County Party Chair and County Party Secretary of the nomination within seven days of the caucus.
    c. If the Legislative District Chair fails to nominate a qualified replacement within seven days of the caucus, the County Party Chair shall nominate a qualified replacement from the legislative district for election at the County Convention, notifying the County Party Secretary of the nomination within twelve days of the caucus.
  3. If a Caucus State Delegate moves from his/her area of eligibility, dies, resigns, or otherwise becomes ineligible to serve, the following rules shall apply for filling the vacancy:
    a. The Precinct Chair shall appoint a qualified replacement from the precinct, notifying the County Party Chair and County Party Secretary of the appointment up to three weeks prior to the State Convention.
    b. If the Precinct Chair fails to appoint a qualified replacement up to three weeks prior to the State Convention, the precinct’s Legislative District Chair shall appoint a qualified replacement from the legislative district, notifying the County Party Chair and County Party Secretary of the appointment up to seventeen days prior to the State Convention.
    c. If the Legislative District Chair fails to appoint a qualified replacement up to seventeen days prior to the State Convention, the County Party Chair shall appoint a qualified replacement from the legislative district, notifying the County Party Secretary of the appointment within fourteen days prior to the State Convention.
H. The County Party Secretary shall submit the final state delegate list to the State Party no later than two weeks before the State Convention.

If approved by the Central Committee, the above proposal would replace Bylaw 1 in its entirety. So, for readability, none of the above proposal is displayed in bold underlined text.
